Magistrate Judge Wang orders OpenAI to preserve and segregate all ChatGPT output logs it would otherwise delete, including those users asked to erase
On May 13, 2025, Magistrate Judge Ona Wang directed OpenAI to "preserve and segregate all output log data" that would otherwise be deleted, on a going-forward basis until further order, whether the deletion would be at a user's request or under privacy laws OpenAI said required it. The two-page order recounts that the News plaintiffs first raised OpenAI's deletion of logs in January 2025, that the court then declined a wholesale preservation order but asked whether deletion-requested data could be segregated or anonymized, and that OpenAI's later letters did not say whether it would preserve such data without an order. The court noted the plaintiffs' letter suggested the volume of deleted conversations was significant. According to Loeb & Loeb, Judge Wang declined to vacate the order on May 16, 2025. The preservation fight was followed by the dispute over production of a 20 million-conversation sample, decided by Judge Wang in November 2025 and affirmed by Judge Stein on Jan. 5, 2026.

What the labels mean
Every item says what kind of source it rests on. A court ruling or order is the court's own statement. A company filing is what a defendant says about itself. A government filing is a statement by a government agency that is not a party to the case, such as a statement of interest; it is the government's position, not a ruling. An allegation is what a complaint or motion claims and has not been decided. Reported means press reporting we have not confirmed from the primary document. Summaries are our own; follow the links for the source.
This page is general information, not legal advice. An allegation is not a finding. Whether any of this matters for a particular work or claim is a question for a lawyer.
