Databricks and MosaicML admit MosaicML downloaded Books3, copied it to cloud storage and used a fiction subset to fine-tune a model
In their answer to the second amended consolidated complaint, Databricks and MosaicML admit that MosaicML downloaded copies of the RedPajama books subset and of Books3, and made copies of both in cloud storage buckets, including on Amazon and Oracle services. They admit MosaicML used the RedPajama books subset to train its MPT-7B, MPT-30B and MPT-7B-StoryWriter models, and used a filtered fiction subset of Books3 to fine-tune the StoryWriter model. They admit they obtained RedPajama in April 2023 and did not seek permission from or pay the plaintiffs. They admit Databricks acquired MosaicML in July 2023 and took on its assets and liabilities. They deny distributing datasets to customers and plead fair use. An earlier answer, in September 2025, admitted only that parts of the RedPajama books subset were used for two models. Parts of the public version of this answer are redacted. These are the defendants' own statements; the court has made no findings.

What the labels mean
Every item says what kind of source it rests on. A court ruling or order is the court's own statement. A company filing is what a defendant says about itself. A government filing is a statement by a government agency that is not a party to the case, such as a statement of interest; it is the government's position, not a ruling. An allegation is what a complaint or motion claims and has not been decided. Reported means press reporting we have not confirmed from the primary document. Summaries are our own; follow the links for the source.
This page is general information, not legal advice. An allegation is not a finding. Whether any of this matters for a particular work or claim is a question for a lawyer.
