Jamendo refiles its copyright suit against NVIDIA, alleging the Fugatto and Audio Flamingo audio models were trained on its non-commercial MTG-Jamendo music dataset and exclusively licensed tracks
Filed Oct. 12, 2026 in the Northern District of California, three days after Jamendo voluntarily dismissed the suit it first filed on June 22, 2026. Jamendo says NVIDIA's own research papers name the MTG-Jamendo Dataset, about 55,000 tagged tracks released in 2019 for non-commercial research under a CC BY-NC-SA 4.0 licence, as training data for Fugatto and Audio Flamingo, even though NVIDIA described that data as "exclusively comprised of open source data". Jamendo claims copyright in the dataset and the larger Jamendo Database as compilations (registered June 17 and July 10, 2026) and in tracks for which it holds exclusive commercial rights, and says NVIDIA ignored licensing talks from 2024 to June 2025, then refused invoices sent in September 2025 by denying any contractual relationship. Six counts: two copyright, two for breach of the Creative Commons licence and site terms, unjust enrichment and California unfair competition. It seeks an injunction, destruction of copies and at least EUR 17.8 million or statutory damages. A parallel Belgian action in Ghent survived a jurisdiction objection in June 2026. These are the plaintiff's allegations; NVIDIA has not responded.

What the labels mean
Every item says what kind of source it rests on. A court ruling or order is the court's own statement. A company filing is what a defendant says about itself. A government filing is a statement by a government agency that is not a party to the case, such as a statement of interest; it is the government's position, not a ruling. An allegation is what a complaint or motion claims and has not been decided. Reported means press reporting we have not confirmed from the primary document. Summaries are our own; follow the links for the source.
This page is general information, not legal advice. An allegation is not a finding. Whether any of this matters for a particular work or claim is a question for a lawyer.
